Welcome to LivenForest! These Terms of Use (the "Terms") constitute a legally binding agreement between you ("User" or "you") and the operator of the Service ("we," "us," or "our") regarding your use of the LivenForest application and related services (the "Service"). The Service is provided by individual operators: the International version (LivenForest, app ID com.livenforest.app) is operated by Junwen Hu; the China version (小森里, app ID com.livenforest.app.cn) is operated by Hu Junwen (胡隽雯). The two versions are two separate apps on the App Store, operated independently, and their data is not shared between them. Please read these Terms carefully before using the Service, paying particular attention to bolded or otherwise highlighted provisions. If you do not agree to any of these Terms, please do not use the Service. By using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Service Description
LivenForest is an AI-powered plant identification and digital asset management application that provides the following services:
- Plant Identification & Profiles: Identify plant species by taking photos or importing from your photo library using AI technology, automatically generating plant profiles including species information and care tips.
- Healing Moments: Record and share moments of your life with plants, with support for photo uploads and AI-generated captions.
- Digital Asset Generation: Create stylized 2D digital assets from plant photos using AI technology.
- Guardian System: A virtual companion that provides interactive experiences.
- Cloud Backup: Back up your plant data, assets, and healing moments to the cloud for cross-device synchronization.
- Sharing: Generate shareable links for plant profiles and healing moments.
- Energy System & In-App Purchases: Use energy to access premium features, obtainable through Apple In-App Purchases.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
2. Account Registration & Management
- Registration Method: The Service supports third-party authentication sign-in only; no standalone email/password registration is available. The International version (LivenForest) supports sign-in with an Apple Account or a Google Account; the China version (小森里) supports sign-in with an Apple Account only and does not offer Google sign-in.
- Account Information: Upon registration, we will obtain necessary information from your authorized third-party account (such as display name and email address). You may modify your username, avatar, and bio within the app.
- Account Security: You are responsible for safeguarding your third-party account credentials. We are not liable for any losses resulting from compromised third-party accounts. If you discover unauthorized use, please contact us immediately.
- One Account Per User: Each third-party account may only be linked to one LivenForest account.
- Account Deletion: You may delete your account at any time, on a self-service basis, via My → Delete Account in the App. Once submitted, we will immediately delete all personal information and data associated with your account (irreversible), except information we are expressly required to retain by applicable laws and regulations.
3. User Conduct
When using the Service, you agree to:
- Comply with all applicable laws and regulations in your jurisdiction.
- Not use the Service for any unlawful activities.
- Not upload, publish, or share content that:
- Violates any applicable laws or regulations;
- Infringes upon the intellectual property, portrait rights, privacy, or other legitimate rights of others;
- Contains pornographic, violent, terroristic, or gambling-related material;
- Is false or misleading;
- Contains malware, viruses, or harmful code.
- Not interfere with or disrupt the normal operation of the Service, including but not limited to attacking servers, reverse engineering, or unauthorized data scraping.
- Not abuse AI features, including but not limited to submitting excessive meaningless requests to consume system resources.
- Not obtain energy or other virtual benefits through illegitimate means.
We reserve the right to warn, restrict features, suspend, or terminate accounts of users who violate these rules.
4. User Content
- Ownership: You retain the intellectual property rights to the original photos and text content you upload to the Service.
- License Grant: By uploading content to the Service, you grant us a non-exclusive, royalty-free license to use, store, and process your content to the extent necessary to provide the Service.
- AI-Generated Content: Digital assets, plant information, and text descriptions generated by AI technology based on your photos are subject to the terms of the relevant AI service providers and applicable laws. You may freely use such AI-generated content within the Service.
- Shared Content: When you use the sharing feature, shared content will be accessible to others through public links. You are responsible for ensuring that shared content does not infringe upon any third party's rights.
- Content Moderation: We reserve the right to review user content and remove content that violates these Terms or applicable laws.
5. In-App Purchases & Energy System
- Energy System: The Service uses "Energy" as virtual currency to unlock and use premium features (such as AI plant identification, digital asset generation, etc.).
- Acquisition Methods: Energy can be obtained through Apple In-App Purchases or through limited daily free allowances.
- Purchase Terms: All in-app purchases are processed through the Apple App Store and are subject to Apple's terms of service and refund policies.
- Virtual Currency Nature: Energy is a virtual benefit with no real-world monetary value. It is non-transferable and non-refundable (unless otherwise required by applicable law or permitted by Apple's refund policy).
- Price Adjustments: We reserve the right to adjust energy pricing and free allowances, with prior notice provided through the app.
- Subscriptions: If subscription services are introduced, relevant terms will be communicated separately. Subscription renewal and cancellation follow Apple App Store rules.
6. AI Service Disclaimer
- Accuracy: AI plant identification and information generation are based on machine learning technology. Results are for reference only and are not guaranteed to be 100% accurate. For safety-related information such as plant toxicity or edibility, please consult professional resources.
- Care Advice: AI-generated plant care advice is for reference only and does not constitute professional horticultural guidance. We are not liable for any plant damage resulting from reliance on AI advice.
- Service Availability: AI features depend on third-party AI service providers and may be temporarily unavailable due to network conditions or provider maintenance.
- Generated Content: AI-generated text descriptions and images may contain inaccuracies. We make no guarantees regarding their completeness or suitability.
7. Intellectual Property
- All intellectual property rights in the application, interface design, icons, logos, and technical architecture belong to us or have been lawfully licensed to us.
- You may not copy, modify, distribute, sell, or otherwise use any content in the Service to which we hold intellectual property rights without our written permission.
- LivenForest, the LivenForest logo, and related marks are our trademarks and may not be used without authorization.
8. Privacy
We are committed to protecting your privacy and personal information. For details on how we collect, use, store, and protect your personal information, please refer to our Privacy Policy, which is an integral part of these Terms.
9. Disclaimer & Limitation of Liability
- The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no express or implied warranties regarding the continuity, reliability, or accuracy of the Service.
- We shall not be liable for service interruptions or losses caused by:
- Force majeure events (natural disasters, policy changes, network failures, etc.);
- User device or network issues;
- Third-party service failures;
- User's own fault.
- To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or punitive damages arising from the use of the Service. Our total liability shall not exceed the amount you actually paid for the Service in the 12 months preceding the dispute.
10. Modifications to Terms
- We reserve the right to modify these Terms as necessary. Modified Terms will be published within the app or on our official website.
- Material changes will be communicated in advance through in-app notifications, push messages, or website announcements.
- Modified Terms take effect upon publication. Your continued use of the Service after modification constitutes acceptance of the updated Terms.
- If you disagree with the modified Terms, you may stop using the Service and delete your account.
11. Termination
- You may stop using the Service at any time.
- We may suspend or terminate your access to the Service if:
- You violate any provision of these Terms;
- Required by law or regulatory authorities;
- For security reasons;
- We decide to discontinue the Service.
- Upon termination, we will handle your personal information and data in accordance with our Privacy Policy.
12. Governing Law & Dispute Resolution
- China version (小森里): These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China (excluding Hong Kong, Macau, and Taiwan for the purpose of these Terms). Any dispute shall first be resolved through amicable negotiation; if negotiation fails, either party may submit the dispute to the competent people's court at the operator's principal place of business.
- International version (LivenForest): These Terms shall be governed by the laws of the operator's place of establishment (Canada), without prejudice to the mandatory statutory rights you enjoy under the laws of your country or region (including consumer protection and data protection laws). Disputes shall first be resolved through amicable negotiation.
- Regardless of the governing law, nothing in these Terms shall affect the statutory rights you have under the mandatory laws of your local jurisdiction.
13. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms (including the Privacy Policy) constitute the entire agreement between you and us regarding the use of the Service.
- Waiver: Our failure to exercise or delay in exercising any right under these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign any rights or obligations under these Terms without our written consent.
