Terms of Use

LivenForest is an AI-powered plant care application that provides the following services:

1. Plant Identification & Profiles: Identify plant species by taking photos or importing from your photo library using AI, automatically generating plant profiles including species information and care guidance.
2. Care Plan & Check-ins: Estimate watering, fertilizing and other care rhythms from the species' characteristics, the growing environment you describe (pot, substrate, window orientation, indoor temperature and humidity) and local weather. Every check-in you log is used to calibrate future plans.
3. Today's Weather & Care Reminders: Retrieve local weather and flag which plants are too cold, too hot, too dry or too damp based on each plant's tolerance range, notifying you through on-device local notifications.
4. Plant Portraits & Growth Records: Cut your plant out of its photo and trace it into vector artwork, used as that plant's portrait inside the App; and record status photos and notes across a plant's life. This is image processing applied to your own photo (background removal and vector tracing) — no generative AI draws a new image.
5. Bouquet: Arrange your plant portraits into a bouquet on the home screen, and look back at how it appeared at earlier points in time.
6. Guardian: A virtual companion offering AI conversation, patrol diaries and gifts.
7. Cloud Backup: Members can back up plant profiles, care records and portraits to the cloud for cross-device restore.
8. Membership & In-App Purchases: Subscribe through Apple In-App Purchase to unlock unlimited plants, unlimited guardian conversations, cloud backup and other benefits.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

1. Registration Method: The Service supports third-party authentication sign-in only; no standalone email/password registration is available. The International version (LivenForest) supports sign-in with an Apple Account or a Google Account; the China version (小森里) supports sign-in with an Apple Account only and does not offer Google sign-in.
2. Account Information: Upon registration, we will obtain necessary information from your authorized third-party account (such as display name and email address). You may modify your username, avatar, and bio within the app.
3. Account Security: You are responsible for safeguarding your third-party account credentials. We are not liable for any losses resulting from compromised third-party accounts. If you discover unauthorized use, please contact us immediately.
4. One Account Per User: Each third-party account may only be linked to one LivenForest account.
5. Account Deletion: You may delete your account at any time, on a self-service basis, via My → Delete Account in the App. Once submitted, we will immediately delete all personal information and data associated with your account (irreversible), except information we are expressly required to retain by applicable laws and regulations.

When using the Service, you agree to:

1. Comply with all applicable laws and regulations in your jurisdiction.
2. Not use the Service for any unlawful activities.
3. Not upload, publish, or share content that:
   • Violates any applicable laws or regulations;
   • Infringes upon the intellectual property, portrait rights, privacy, or other legitimate rights of others;
   • Contains pornographic, violent, terroristic, or gambling-related material;
   • Is false or misleading;
   • Contains malware, viruses, or harmful code.
4. Not interfere with or disrupt the normal operation of the Service, including but not limited to attacking servers, reverse engineering, or unauthorized data scraping.
5. Not abuse AI features, including but not limited to submitting excessive meaningless requests to consume system resources.
6. Not obtain membership benefits or other virtual benefits through illegitimate means.

We reserve the right to warn, restrict features, suspend, or terminate accounts of users who violate these rules.

1. Ownership: You retain the intellectual property rights to the original photos and text content you upload to the Service.
2. License Grant: By uploading content to the Service, you grant us a non-exclusive, royalty-free license to use, store, and process your content to the extent necessary to provide the Service.
3. AI-Generated Content: Plant information and text generated by AI (plant profiles, care guidance, guardian replies) is subject to the terms of the relevant AI service providers and applicable laws. You may freely use such content within the Service. Plant portraits produced from your photo by background removal and vector tracing are not AI-generated content — they are a processed form of your own photo, and rights in them follow the original photo.
4. Content Moderation: We reserve the right to review user content and remove content that violates these Terms or applicable laws.

1. Membership: LivenForest membership is offered on a monthly or yearly basis. It unlocks unlimited plants, unlimited guardian conversations, all smart care reminders, cloud backup, and guardian gifts, diaries and care records. Free users keep access to the core features, subject to limits on the number of plants and guardian conversations.
2. Price & Billing: Prices are those shown in the App and on the App Store and may differ by country or region. Payment is charged to your Apple Account when you confirm the purchase.
3. Auto-Renewal: Subscriptions renew automatically. Unless auto-renewal is turned off at least 24 hours before the end of the current period, Apple will charge the same plan within 24 hours before the period ends and renew your subscription.
4. How to Cancel: Manage or cancel your subscription in iOS Settings → Apple Account → Subscriptions. We cannot cancel it on your behalf. After cancelling, membership benefits remain available until the end of the current period and are not renewed thereafter.
5. Refunds: All purchases are processed by the Apple App Store and refunds are governed by Apple's terms and refund policy. Please request refunds directly from Apple.
6. Price & Benefit Changes: We may adjust subscription prices and the scope of benefits. Price increases will be notified in advance in accordance with Apple's rules and take effect only after you agree to them.
7. Nature of Benefits: Membership benefits are a virtual service. They are non-transferable and have no real-world monetary value.
8. Fair use: "Unlimited" means no limits on normal personal use — it does not permit unlimited automated requests. To keep the service available to everyone, each account has a monthly AI usage ceiling set far above normal usage levels (measured per billing period and reset each period). You should only ever reach it through abnormal use; we will warn you in the app as you approach it. Once reached, the affected AI features pause until the next period — all other features and your existing content are unaffected. We may adjust this ceiling based on actual costs and usage patterns.

1. Accuracy: AI plant identification and information generation are based on machine learning technology. Results are for reference only and are not guaranteed to be 100% accurate. For safety-related information such as plant toxicity or edibility, please consult professional resources.
2. Care Advice: AI-generated plant care advice is for reference only and does not constitute professional horticultural guidance. We are not liable for any plant damage resulting from reliance on AI advice.
3. Service Availability: AI features depend on third-party AI service providers and may be temporarily unavailable due to network conditions or provider maintenance.
4. Generated Content: AI-generated text (plant profiles, care advice, guardian replies) may contain inaccuracies, and we make no guarantees as to its completeness or suitability. Plant portraits are produced by background removal and vector tracing rather than AI image generation, but the traced result may differ from the original photo in colour or detail.

1. All intellectual property rights in the application, interface design, icons, logos, and technical architecture belong to us or have been lawfully licensed to us.
2. You may not copy, modify, distribute, sell, or otherwise use any content in the Service to which we hold intellectual property rights without our written permission.
3. LivenForest, the LivenForest logo, and related marks are our trademarks and may not be used without authorization.

We are committed to protecting your privacy and personal information. For details on how we collect, use, store, and protect your personal information, please refer to our Privacy Policy, which is an integral part of these Terms.

1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no express or implied warranties regarding the continuity, reliability, or accuracy of the Service.
2. We shall not be liable for service interruptions or losses caused by:
   • Force majeure events (natural disasters, policy changes, network failures, etc.);
   • User device or network issues;
   • Third-party service failures;
   • User's own fault.
3. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or punitive damages arising from the use of the Service. Our total liability shall not exceed the amount you actually paid for the Service in the 12 months preceding the dispute.

1. We reserve the right to modify these Terms as necessary. Modified Terms will be published within the app or on our official website.
2. Material changes will be communicated in advance through in-app notifications, push messages, or website announcements.
3. Modified Terms take effect upon publication. Your continued use of the Service after modification constitutes acceptance of the updated Terms.
4. If you disagree with the modified Terms, you may stop using the Service and delete your account.

1. You may stop using the Service at any time.
2. We may suspend or terminate your access to the Service if:
   • You violate any provision of these Terms;
   • Required by law or regulatory authorities;
   • For security reasons;
   • We decide to discontinue the Service.
3. Upon termination, we will handle your personal information and data in accordance with our Privacy Policy.

1. China version (小森里): These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China (excluding Hong Kong, Macau, and Taiwan for the purpose of these Terms). Any dispute shall first be resolved through amicable negotiation; if negotiation fails, either party may submit the dispute to the competent people's court at the operator's principal place of business.
2. International version (LivenForest): These Terms shall be governed by the laws of the operator's place of establishment (Canada), without prejudice to the mandatory statutory rights you enjoy under the laws of your country or region (including consumer protection and data protection laws). Disputes shall first be resolved through amicable negotiation.
3. Regardless of the governing law, nothing in these Terms shall affect the statutory rights you have under the mandatory laws of your local jurisdiction.

1. Severability: If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
2. Entire Agreement: These Terms (including the Privacy Policy) constitute the entire agreement between you and us regarding the use of the Service.
3. Waiver: Our failure to exercise or delay in exercising any right under these Terms shall not constitute a waiver of that right.
4. Assignment: You may not assign any rights or obligations under these Terms without our written consent.
